Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
SYMPTOMIQ’S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES SHALL NOT EXCEED THE GREATER OF:
(A) THE AMOUNT PAID BY YOU TO SYMPTOMIQ DURING THE PRECEDING TWELVE (12) MONTHS; OR
(B) AUD $100.
UNDER NO CIRCUMSTANCES SHALL SYMPTOMIQ BE LIABLE FOR:
- INDIRECT DAMAGES;
- INCIDENTAL DAMAGES;
- SPECIAL DAMAGES;
- CONSEQUENTIAL DAMAGES;
- EXEMPLARY DAMAGES;
- PUNITIVE DAMAGES;
- LOSS OF PROFITS;
- LOSS OF BUSINESS;
- LOSS OF GOODWILL;
- LOSS OF DATA;
- LOSS OF OPPORTUNITY;
- PERSONAL INJURY;
- HEALTH OUTCOMES;
- DEATH.
WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE.
Third-Party Services
The Services may link to or integrate with third-party services.
SymptomIQ is not responsible for third-party content, products, policies, or conduct.
Suspension and Termination
SymptomIQ may suspend, restrict, or terminate access at any time, with or without notice, for any reason.
Termination shall not affect accrued rights, obligations, disclaimers, limitations of liability, indemnities, or dispute resolution provisions.
Dispute Resolution
Before commencing formal proceedings, parties agree to attempt good-faith resolution through written notice.
Any dispute not resolved within thirty (30) days shall be submitted to confidential binding arbitration administered under the laws of Victoria, Australia.
The arbitration decision shall be final and binding.
Nothing prevents SymptomIQ from seeking injunctive or equitable relief where necessary.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of Victoria, Australia.
The courts of Victoria, Australia shall have exclusive jurisdiction over matters not subject to arbitration.
Severability
If any provision is found unenforceable, the remaining provisions shall remain in full force and effect.
Entire Agreement
These Terms constitute the entire agreement between the user and SymptomIQ regarding the Services.
